Terms of service

These Terms of Service ("Terms") govern your access to and use of the Adsycom platform, including our web application at adsycom.io, our Chrome extension and any related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility and accounts

You must be at least 18 years old and able to enter into a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at security@adsycom.io if you suspect unauthorised access.

2. Access

Adsycom is currently invite-only. We may grant, suspend or revoke access at our discretion. We may also impose usage limits, feature restrictions or quotas as needed to protect the integrity and performance of the Service.

3. Acceptable use

You agree not to:

• Use the Service to violate any law or the rights of any third party.
• Reverse-engineer, decompile, scrape or attempt to extract source code, except as expressly permitted by law.
• Use the Service to send unsolicited communications, malware or other harmful content.
• Use the Service to infringe intellectual property, including by uploading or storing copyrighted creatives you don't have rights to.
• Bypass or attempt to bypass our security or access controls, or another user's data.
• Use the Service in ways that violate Meta's Platform Terms or any other third-party terms that apply to integrations you connect.

4. Your content

You retain ownership of the content you upload to or generate within the Service (products, creatives, tags, notes, tasks, screenshots of ads saved via our extension, etc.). You grant Adsycom a non-exclusive, worldwide licence to host, process and display that content solely to operate the Service for you and your team.

You are solely responsible for the content you store and for ensuring you have the rights to do so.

5. Third-party services

The Service integrates with third-party platforms, including Meta Ads. When you connect a third-party account, you authorise Adsycom to access and process data from that account on your behalf, subject to the third party's own terms and privacy policies. We are not responsible for those third-party services, their availability or their pricing.

6. Intellectual property

Adsycom, including the software, design, branding and documentation, is owned by us and protected by intellectual property laws. These Terms do not grant you any right or licence to our IP except the limited right to use the Service in accordance with these Terms.

7. Fees

The Service is currently provided to invited teams without charge. We may introduce paid plans in the future. If we do, we will give you reasonable notice before any charges apply to your account.

8. Service availability

We work hard to keep the Service available and performant, but we do not guarantee uninterrupted access. The Service may be unavailable during maintenance windows or due to factors outside our reasonable control (e.g. outages at our hosting providers or at Meta).

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Adsycom does not make any guarantees about the accuracy of metrics fetched from third-party platforms (including Meta Ads), or about financial outcomes obtained by using the Service. The economic calculations the Service provides are decision-support tools, not financial advice.

10. Limitation of liability

To the maximum extent permitted by law, Adsycom and its founders, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill or other intangible losses, resulting from your use of the Service.

Where liability cannot be excluded, our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) USD 100.

11. Indemnification

You agree to indemnify and hold Adsycom harmless from any claim arising out of (a) your use of the Service, (b) your violation of these Terms or (c) your violation of any third-party rights, including IP rights.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that creates risk for us or other users. On termination, your right to use the Service ends immediately; sections that by their nature should survive (IP, disclaimers, limitation of liability, governing law) will survive.

13. Governing law

These Terms are governed by the laws of the People's Democratic Republic of Algeria, without regard to conflict-of-laws principles. Any dispute will be brought before the competent courts of Blida, Algeria, unless mandatory consumer-protection law requires otherwise.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Effective date" above. For material changes, we will notify you via the Service or by email. Your continued use of the Service after a change becomes effective constitutes acceptance of the updated Terms.
